Fragility of International Law
Abstract
This study of the fragility of international law is considered one of the most important topics raised in the political and legal arena. It examines the gap that exists within the legal texts, rules, and international laws that regulate relations among states. The study highlights the fragility of international law in practice, rather than focusing on idealistic laws formulated only on paper.
International law largely depends on the consent of dominant states that possess great power, often marginalizing weaker states that lack significant influence compared to major powers. Powerful states sometimes use international laws as a cover or instrument to achieve their objectives and economic interests without sufficient regard for states that are economically and militarily weaker.
This situation leads to an imbalance in achieving justice and equality among states. It also reveals a clear double standard, where international law is strictly applied to weaker states, while certain rules may be overlooked when they conflict with the interests of major powers. The study therefore aims to shed light on these issues and analyze their implications.
